Non-legal info. & advice on the completion of our Will form
If you die without leaving a Will the law will dictate how your money and possessions are to be distributed.
If you are not married but live with ANY partner a Will for both of you is essential to carry out your wishes.
If you have children you must state your wishes where they are to benefit from YOUR rightful estate.
If you have a complex bequeaths and/or estate seek advice or keep your wishes SIMPLY expressed.
It is not necessary to use a solicitor/lawyer for a Will to be legal and acceptable.
You have to be over the age of 18 in England and Wales and over 12 in Scotland.
You should appoint a guardian of your children who are under 18.
Re-writing a new Will replaces an older one, the old one should totally destroyed by you.
This is not a Living Will or an Enduring Power of Attorney.
This Will should not dictate what happens to your useful organs, separate arrangement should be registered.
Our simple Last Will & Testament form is for you to print to make a Will RIGHT NOW - at least this form should provide the basic but explicit expression of your wishes when you die. If you are in any doubt whatsoever take LEGAL advice. It is important to print the pages as one piece of paper so take care to print side one then side 2 on the reverse. Pre-compose what you wish to Type or Write neatly with simple expression in unambiguous English. If you need to carry over to the other side STRIKE THROUGH the 1st page signature spaces and write continued overleaf. Do not add scraps of paper, if your wishes cover more than these pages you may need advice. You are the Testator making this Will, the Executor is someone you appoint (with their agreement) to deal with your will, he/she can benefit from your Will but they cannot witness it. The Executor has to collect all your debts together with any assets in your estate, he/she will pay (for example) funeral cost or deal with matters required to settle credit or deal with insurance payouts etc: You can appoint TWO Executors (or three) if you wish, these may include relatives, friends, accountants, banks or solicitors - BUT realise that fees maybe involved from the latter. 2 Witnesses over the age of 18 are required and must not be beneficiaries - therefore do not use anyone in your immediate family or a partner (male or female) you wish to benefit from your Will. Witnesses do not need to see the explicit contents of your Will but they have to be present when you sign it and should provide their printed name and address. There is reference to a Codicil (a simple amendment to any existing Will to add say new Executors), we suggest it is less complicated to simply rewrite a new Will expressing your changed wishes, different amounts, or different Executors.
Simply express your wishes in as few words as you can, do not use words you may not understand the implications of. When mentioning amounts - write the number and words [i.e. 200 = two hundred] Do not leave spaces or lines between your wishes and your signature - draw a zig-zag from the empty space/line down to where you sign. (so nothing can be inserted you did not intend). Sign and print your name after 'signed by me____' and ask your witnesses to print and sign their names after 'in the presence of____' providing their occupation and full address.
You may wish to photocopy the will and deposit the original in a safe place, sometimes your Bank or Building Society may look after it. You may store the original in a safe place and tell your executors where it is and there are official places where you can store a will.
